Rules governing the use of our services

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Yevhenii Danishevskyi Consultancy ("we," "us" or "our"), concerning your access to and use of our website and consulting services.

2. Nature of Services (Non-Legal)

You expressly acknowledge and agree that:

  • We are NOT a law firm and we do NOT provide legal advice.
  • No attorney-client relationship is created between you and us.
  • Our services are limited to administrative consulting, strategic guidance, document organization, and general information based on publicly available USCIS resources.
  • Any information, templates, or guidance provided should not be considered a substitute for the advice of a licensed attorney.
  • You maintain full responsibility for the content, accuracy, and submission of your immigration petitions.

3. No Guarantees of Outcome

We do not and cannot guarantee any specific outcome for your immigration case. Approvals of EB-1A or any other visa petitions are at the sole discretion of the United States Citizenship and Immigration Services (USCIS). Past success of other clients does not guarantee a similar outcome for your case.

4. Intellectual Property Rights

Unless otherwise indicated, the Site and our proprietary templates, strategies, and materials are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

5. Payment and Refund Policy

Fees for consulting services are outlined in individual service agreements. Due to the nature of consulting services and intellectual property provided, refunds are generally not offered once services have commenced or proprietary materials have been delivered, unless explicitly stated in your specific service agreement.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our services.

7. Governing Law

These Terms shall be governed by and defined following the laws of Ukraine. Yevhenii Danishevskyi Consultancy and yourself irrevocably consent that the courts of Ukraine shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
